Bad Bills:
HB 1447 will allow non-charter
counties to adopt noise ordinances [Roorda] 01/10/2008 Referred: Local
Government (H)
It is a bad bill since this
bill does not contain an exemption for shooting ranges from the noise
ordinances.
HB 1651 adds active
duty military, reserves, National Guard, and those who have been discharged
with an Honorable or General Under Honorable Conditions to those who
do not need training to receive a Missouri CCW endorsement. [Dethrow]

This is a bad bill. It does
not require any legal training for them so they won’t know WHEN they
MAY shoot. Not all military personnel receive adequate training in firearms
use.
HB

HB 2278 waives NICS
checks for firearms purchases by those with concealed carry endorsement.

This is a questionable bill.
The intention looks to be good, but the language may be ineffective.
HB 2498 requires the
Department of Conservation to pay the owner of motor vehicle the first
$250 of any damage caused to a motor vehicle that collides with a deer.
[Quinn] This may be a bill to punish the DOC.
Good Bills:
HB 1383 prohibits businesses
from prohibiting firearms in vehicles, except vehicles owned by the
business. Also businesses are under no duty to guard against criminal
acts by a third person, except under certain circumstances. Also businesses
are under no duty to protect duty to protect their customers. [Cox]

This is a good bill and should
be supported and passed.
HB 1765 prohibits the
release of PTA records unless by court order. [Parson] Special Committee
on General Laws. Voted do pass.
This is a good bill.
HB 1798 seems to say
that someone who invites or allows others to hunt or fish on their land
is not responsible for injuries to those people. [Ruzicka] Conservation
and Natural Resources Committee. Heard 26 Mar 08.
This looks like a good bill.
HB 1975 changes the
concealed carry permit from three years to six years. [Scharnhorst]
Special Committee on General Laws. Heard 25 Mar 2008. Voted do pass.
This is a good bill and should
be supported and passed.
HB 1982 removes the
six month residency from the requirements to obtain a Missouri concealed
carry endorsement. [Thomson] 02/21/2008 - Referred: Special Committee
on General Laws (H) Voted Do Pass.
This is a good bill and should
be supported and passed.
HB 2034 creates Hunting
Preserves and Committee Substitute provides protection for shooting
ranges. [Munzlinger] Third read and passed.
This is a good bill and should
be supported and passed.
HB 2053 removes the
exceptions to no duty to retreat. [Jones (113)] Special Committee on
General Laws. Heard 25 Mar 08. Voted do pass.
This is a good bill and should
be passed.
HB 2146 will allow non-charter
counties to adopt noise ordinances. [Wilson (119)]
This is a better bill than
HB 1447 since it gives exception to the noise ordinances for shooting
ranges.
This is the same as SB 1145.
HB 2238 removes the
requirement that a valid hunter has to have a safety sticker on their
shotgun while hunting wild turkeys. [Schad] Conservation and Natural
Resources Committee.
This looks like it is a good
bill and gets rid of a nanny-state rule.
HB 2261 public ranges
owned and operated by the state of Missouri will allow the use
of B27 targets. [Sander] Hearing Heard, Referred Rules Pursuant to Rule
25(21)(f) (H)
This is a good bill.
HB 2321 establishes
hunter voter. Voter registration forms to be made available to Department
of Conservation to be distributed. Applicants to be informed that they
are responsible for mailing to completed form to appropriate election
authority. [Dixon] Referred to Senate Financial, Government Org.,
and Election committee.
This looks like a good bill
in that it encourages hunters to register to vote. Hopefully they will
vote, and vote for pro-gun candidates.
HB 2546 requires local
ordinances allowed under general preemption of firearms to incorporate
justification defenses. Removes political jurisdiction’s
authorization to restrict open carry. [Tilley]
This looks good.
HCR 32 recognizes the
NRA’s Eddie Eagle Gunsafe Program. [Onder]
Bills to be Watched:
HB 1411 would change
571.070 from prohibiting possession of a concealable firearm by someone
who has been convicted of a dangerous felony to prohibiting possession
of a firearm by someone who has been convicted of a felony [Darrough]
Referred: Special Committee on General Laws (H) Public hearing
held.
Since federal law prohibits
possession of a firearm by anyone who has been convicted of a felony,
this law is superfluous and needs to be merely watched. For those
that will be adversely affected, they should seek a pardon from the
appropriate Governor or the President.

The Senate bills are;
Bad Bills:
SB 812 expands unlawful
use of a weapon to include discharge of a firearm in the air for celebratory
purposes in an urban area. [Wilson] 1/14/2008 - Second Read and Referred

This is a bad bill, as if passed
it could be interpreted to prohibit self defense or shooting at a range.
SB 813 makes possession
of tasers or stun guns illegal except for certain persons. [Wilson]

This is a bad bill since it
would prohibit possession or use of these less-than-lethal devices by
all but a select group of people.
SB 836 creates the crime
of negligent storage of a firearm. Lock up your safety.

This is a bad bill.
SB 1184 makes certain
changes regarding domestic violence. Includes language that allows police
to seize firearms if police have probable cause to believe domestic
assault has occurred and a firearm is observed at the scene. [Bray]
Judiciary and Civil & Criminal Jurisprudence committee.
This is a bad bill because
of the seizure language. HB 2340 has the same domestic violence language
without the gun grab.
SB 1200 will require
each bullet to be etched on its base with a unique identifier and ammunition
sellers will have to record who the bullets or ammunition was sold to,
and maintain the records for at least three years. [Bray] Judiciary
and Civil & Criminal Jurisprudence Committe
This is a very bad bill.
Good Bills:
SB 834 – See SB
982
SB
982 includes language that creates an absolute defense against civil
liability or prosecution for killing a dog in certain circumstances.
[Purgason] Combined with SB 834 and SB 819. Senate informal calendar
for perfection.
This is a good bill, expanding
self defense to explicitly include protecting against a dangerous animal.
SB 1076 creates Hunting
Preserves and gives them the protections that we want for ranges. [Engler]
Judiciary and Civil & Criminal Jurisprudence Committe
This is a good bill and should
be supported and passed.
SB 1145 will allow non-charter
counties to adopt noise ordinances. [Scott] Economic Development, Tourism
& Local Government. Hearing
held 16 Apr 08.
This is a better bill than
HB 1447 since it gives exception to the noise ordinances for shooting
ranges.
This is the same as HB 2146.
SB 1176 changes the
Missouri concealed carry endorsement form three to six years. [Barnitz]
Judiciary and Civil & Criminal Jurisprudence
This is a good bill. Same as
HB 1975.
SB 1236 anyone getting
a hunting or fishing permit will get a voter registration card to fill
out and send in. [Crowell] Financial & Governmental Organizations
and Elections.
Hunter-voter bill. This looks
like a good bill in that it encourages hunters to register to vote.
Hopefully they will vote, and vote for pro-gun candidates.
